Definitions
- Service: the Spirit of Nibiru mobile app and website.
- Operator: Axperts Dariusz Zalewski, ul. Pelikana 1/3, 71-698 Szczecin, Poland, VAT ID 851 319 2109, REGON 363785540.
- User: a person using the Service, with or without an account.
- Matrix: the result of calculations made from a date of birth, presented as a diagram and descriptions.
- Account: the User’s data in the Service, shared with the Spirit of Arkanum app from the same Operator.
General provisions
Spirit of Nibiru is a tool for self-knowledge and reflection, based on the Matrix of Destiny, a method that uses the symbolism of the twenty-two Major Arcana.
Use of the basic features, including the full matrix diagram together with its numbers and the calculation path, is free and does not require an account.
The Service may be used by people aged 16 and over.
What this Service is not
The Service is not fortune telling, forecasting or prophecy. It does not determine the future, the state of your health, the outcome of court cases or financial decisions.
The chakra energy map is a symbolic arrangement and is not an assessment of health or a diagnosis.
Content available in the Service serves entertainment and reflection. It does not replace medical, legal or financial advice. The User makes life decisions independently and at their own responsibility.
Registration and account
Creating an account is voluntary and needed only to save data and synchronise it between devices.
An account is created with a one-time code sent to an e-mail address, or with an Apple or Google account. The Operator does not use passwords.
The account is shared with the Spirit of Arkanum app from the same Operator. The privacy policy describes the details. Deleting the account deletes data in both apps.
The User is responsible for the accuracy of the data provided and for securing access to their mailbox and to their Apple or Google accounts.
Features of the app
Within the Service the User may in particular: calculate a matrix from a date of birth, view the full calculation path, check the energy of the day and the energy of a life period, calculate a partner matrix and a child matrix, keep a journal and use the content library.
With the User’s consent the Service also provides features based on artificial intelligence: conversation with the assistant Nova, a full reading in chapters, the Akashic Records, partner and child reports, Daily Energy texts and the energy portrait. Answers from these features are generated by a language model and are reflective and entertaining in nature; the Operator does not guarantee their correctness or repeatability.
The scope of features may change as the Service develops.
User content
Notes, dates and other data entered by the User belong to the User. The Operator does not use them for purposes other than providing the Service.
By entering other people’s dates of birth, the User is responsible for the basis of their use.
Payments and fees
Paid features are sold exclusively through the App Store and Google Play, on their terms and at their prices. The User learns the terms, the billing period and the way to cancel before the purchase, on the purchase screen.
Paid are: the Premium subscription in weekly, monthly and annual variants; one-off reports, meaning the full reading, the Akashic Records, the partner report and the child report; and Sparks, meaning credits for single features such as the energy portrait and an Akashic Records session.
The subscription renews automatically until the User turns it off. Sparks are consumable credits and do not expire. One-off reports are bought once and remain available on the account.
Cancellation of a subscription is carried out in the account settings of the store where it was purchased.
Withdrawal from the contract
Purchases made in the App Store and Google Play are subject to the withdrawal and refund rules of the operator of the given store. Refund requests are handled by the stores, not by the Operator.
The User may erase data gathered in the Service at any time, without giving a reason, in the app settings. Deletion of the account itself, which is shared with the Spirit of Arkanum app, is carried out on a request sent to [email protected], within 30 days.
Limitation of liability
The Operator makes every effort for the Service to run without interruption but does not guarantee its continuous availability. Technical breaks are possible.
The Operator is not liable for decisions taken by the User on the basis of content available in the Service. That content is entertaining and reflective in nature.
These limitations do not exclude or limit the Operator’s liability to the extent that excluding it is not permitted towards a consumer.
Intellectual property
The software, graphics, descriptions and layout of the Service are protected by copyright and belong to the Operator. The User acquires no rights to them, only the right to use the Service in accordance with these terms.
The Matrix of Destiny method is a publicly known and described method. The Operator claims no rights to it; the descriptions and graphics in the Service are the Operator’s own work.
Complaints
We accept complaints at [email protected]. We handle them within 14 days of receipt.
A complaint should contain a description of the problem, the app version and the system on which it occurred.
Changes to these terms
We will announce changes to these terms in the app at least 14 days in advance. Every version has its own effective date. Continued use of the Service after that date means acceptance of the new version. A User who does not accept the new version may erase their data in the app settings and request deletion of the account at [email protected].
Governing law
Polish law applies to the contract. Disputes are settled by the common courts.
This does not limit consumer rights arising from mandatory provisions of the law of the consumer’s country of residence. A consumer may also use the European Union online dispute resolution platform.
